Terms of Use
Review draft ·
Prepared for review. This version is not yet in force.
1. About these terms
Prufo is provided under the name Pomum (“we”, “us” or “our”). These Terms of Use govern the Prufo app, website, checks, reports and related services (the “Service”). Contact us at support@prufo.app.
By accepting these terms or using the Service after they have been made available to you, you agree to them to the extent a binding agreement is formed under applicable law. If you do not agree, do not use the Service. Our Privacy Policy explains how information is processed; accepting these terms does not replace any separate privacy consent required by law.
Prufo provides automated photo-based guidance. Results can be wrong or inconclusive. A report is not an authentication certificate, a warranty about an item or a promise to cover a purchase or sale loss.
2. What a Prufo assessment means
Prufo analyzes submitted photographs of items such as bags, shoes, clothing and accessories using AI. It may provide a result, visible findings, limitations, suggested next steps and related public-source or market information. Available features can depend on the item, submitted evidence and access level.
Our assessments depend on the photos and information available at the time. We do not physically inspect the item, establish its chain of ownership, verify that the photos show the item you will receive, or provide manufacturer certification. Human authentication is not included or promised.
A result such as “Likely authentic” or “Likely fake” expresses an assessment of visible evidence, not certainty. “Inconclusive” means a clear conclusion could not be reached. Some records contain observations only or are illustrative demonstrations. Confidence labels describe the apparent strength of evidence; they are not validated accuracy percentages or probabilities that an item is authentic.
Photos may omit defects or identifying details, depict a different item, be altered, or fail to distinguish a genuine item from a counterfeit. AI may misidentify a model, misread markings or produce unsupported statements. Results can differ with other photos, additional evidence or changes to the analysis system. No result guarantees brand coverage, detection of every counterfeit, completeness, a particular turnaround time or a particular outcome.
Read the whole report, including its limitations. Do not rely on it as the sole basis for buying, selling, insuring, valuing or making a legal claim about an item. Seek an independent physical inspection or other appropriate evidence when the decision matters. You remain responsible for your transactions and statements to other people, subject to any responsibility we cannot exclude by law.
Market information may concern similar items rather than the same model, size, condition or version. Asking prices are not completed sale prices or a valuation of your item. Listings and third-party statements may be inaccurate, outdated or unavailable. Prufo is independent of the brands, manufacturers, marketplaces and sellers mentioned and does not imply their endorsement.
3. Eligibility and guest access
You must be at least 18 and legally able to enter this agreement, or the age of majority where you live if higher. If you use Prufo on behalf of an organization, you must have authority to bind it.
Access to your private checks is associated with your app installation. There is currently no email sign-in or general history-recovery feature. Losing access to the app, resetting your device or reinstalling it may affect access to your reports. Restoring an Apple purchase does not necessarily restore or transfer private report history.
Keep your device and app access secure. Do not share private access information, access someone else’s reports without permission or misrepresent purchase ownership. Contact us promptly if access appears compromised. Saved history is a service feature, not a permanent archival guarantee; keep your own copies of reports you need.
4. Subscriptions, free checks and extra checks
Offers and billing
Paid features are purchased through Apple’s App Store. The purchase screen and Apple’s confirmation show the current local price, currency, billing period, included allowance and any eligible introductory offer. Those transaction-specific details apply to your purchase. Availability and trial eligibility may vary. The website does not take payment.
Subscriptions renew automatically unless cancelled through Apple. Apple charges the payment method associated with your Apple Account and handles renewal under its applicable rules. To avoid a further renewal, cancel before the renewal deadline shown by Apple; for a free or discounted trial, Apple advises cancelling at least 24 hours before it ends. Unless cancelled in time, an eligible trial converts to the paid subscription shown at purchase. A free trial or promotional check is not guaranteed to every user.
Manage or cancel in your iPhone’s Settings → your name → Subscriptions, or use the subscription-management option in Prufo when available. Deleting the app, requesting deletion of data or stopping use does not cancel a subscription. Apple’s subscription screen shows when access ends; cancelling a trial may end trial access immediately. See Apple’s cancellation instructions.
Check allowances
Current monthly and annual Premium plans include 10 completed checks per subscription month. An annual subscription refills this allowance monthly. A subscription month follows the subscription or trial start date, rather than necessarily a calendar month. Unused subscription checks do not roll over. The applicable offer and in-app balance identify your allowance and refill timing.
A completed report consumes a check even if the result is inconclusive or differs from what you expected. A technical failure that produces no completed report does not consume a check. A new submission may use another check. Restoring purchases, changing devices or continuing from a trial into a paid subscription does not reset usage in the current allowance period.
Where offered, an eligible guest may receive a free check with a limited report summary. Eligibility and limits are shown in the app. Unlocking the full version of that report adds access to its available details; it does not perform another assessment or promise a different conclusion.
Extra checks
Available packs of extra checks are one-time purchases, separate from a subscription. An active subscription is currently required both to buy and to use them. Extra checks do not expire; unused extras remain recorded when a subscription ends and become usable again when subscription access is restored to the associated purchase identity. They do not extend a subscription, roll into its monthly allowance or create an entitlement to a particular result.
Check credits are service entitlements, not money, transferable property or a stored-value account. They cannot be exchanged for cash or transferred except where we expressly support it or the law requires it. Refunds or reversed transactions may remove the related entitlement, subject to applicable law.
Restoration, refunds and changes
Use Restore Purchases with the Apple Account used for an eligible subscription. Restoration is subject to Apple’s and the Service’s purchase-verification rules; it does not replenish used checks. If access is delayed or missing, contact us before making a duplicate purchase.
For App Store refund requests, use Apple’s refund process. Except where Apple’s rules or applicable law provide otherwise, completing a check does not entitle you to a refund solely because you disagree with its result. This does not limit remedies for a defective or misdescribed service, unauthorized charges or other mandatory consumer rights.
Price or plan changes will follow applicable notice, consent and App Store requirements. We will not retroactively reduce an already purchased allowance or introduce an expiry for existing extra checks through an unannounced terms update. Any material discontinuation of paid functionality remains subject to your applicable rights to notice, cancellation and remedies.
5. Your content and use of reports
You retain your rights in the photos, descriptions and feedback you submit. You are responsible for having the rights and permissions needed to submit them and for avoiding unnecessary personal information. Provide accurate information and photos of the same item; do not submit misleading or unlawful material.
You grant us a non-exclusive, worldwide, royalty-free license to host, copy, process, format and analyze your submissions, create evidence crops and reports, and allow our service providers to do the same as necessary to deliver, maintain, secure and internally improve the Service. This license is limited to those purposes, the retention described in our Privacy Policy and applicable law. It does not transfer ownership of your photos or authorize unrelated uses of personal information.
Public examples, advertising or other public use of your submitted photos or reports require separate permission. Uploading an item or giving feedback does not by itself grant that permission.
You may use and share reports you lawfully obtain for your own lawful purposes, including in connection with the item assessed. Keep the result, material qualifications, limitations and attribution together. Do not remove uncertainty labels, alter a report to change its meaning, apply it to another item or present it as a manufacturer certificate, an in-person inspection or a guarantee from Prufo.
A report concerns the submitted evidence at the time of analysis. Sharing it does not create a certification service or contractual duty to a recipient. Exported images, identifiers and QR codes do not by themselves prove the authenticity of an item or provide live verification of a report. Our rights in the Service do not give us ownership of third-party trademarks or of your underlying item.
6. Acceptable use
You must not:
- Use the Service to commit fraud, mislead buyers, facilitate unlawful trade, infringe rights or expose another person’s private information without authorization.
- Forge reports, misrepresent affiliation with Prufo or a brand, or remove material limitations from a result you share.
- Bypass access controls, subscription requirements, purchase verification, usage limits or free-check eligibility.
- Access private reports or non-public systems without permission, introduce malicious code, disrupt the Service or overload it with automated requests.
- Scrape or systematically extract the Service’s content, resell access, or use it to build a competing report service without permission.
- Reverse-engineer protected software or defeat technical safeguards, except to the extent such restrictions are prohibited by law or applicable open-source licenses.
Use must comply with applicable laws, including export and sanctions rules. These restrictions do not prevent activity that applicable law expressly protects.
7. Intellectual property
The software, design, branding, original editorial content and other Service materials belong to Pomum or their respective licensors. Except for the rights expressly granted here or required by law, no rights in those materials are transferred to you. Third-party names and marks identify their owners and do not imply a commercial relationship.
Subject to these terms and applicable purchase rights, you may access the Service and use its provided features. You may not sell, sublicense or redistribute the software or our editorial library without permission. The specific permission to use and share your reports is described above.
8. Apple and other third parties
The iOS app is licensed under Apple’s Standard Licensed Application End User License Agreement, unless a separate custom license is expressly supplied through the App Store. These terms set out Prufo’s service conditions and do not replace that software license. Apple’s applicable store terms govern App Store transactions, usage rules and purchase management.
Pomum provides the Prufo Service. Apple does not provide Prufo’s assessments or owe support for them. Any rights or obligations Apple has under its own agreements or applicable law remain unaffected.
The Service may link to external sources or use third-party infrastructure. Their separate terms and privacy notices apply to your direct use of those services. We do not control third-party listings, seller conduct, external content or availability. Linking to a seller does not make us a party to a transaction with that seller.
9. Service changes, suspension and termination
We may update features and analysis methods, correct errors or temporarily interrupt the Service for maintenance, security or events outside our reasonable control. We do not promise uninterrupted availability or support for every device, item or brand.
We may restrict or suspend access where reasonably necessary to address a material breach, fraud, unlawful activity, a security risk or a legal obligation. We will provide notice and an opportunity to resolve the issue where appropriate, unless doing so would be unlawful, impractical or create a security risk. Restrictions will be proportionate to the reason for them.
You may stop using the Service at any time, cancel renewal through Apple and request data deletion as described in our Privacy Policy. Suspension or termination does not automatically cancel App Store billing. If we permanently discontinue paid services, we will provide reasonable notice where practicable and any remedy required by applicable law. Accrued payment obligations, lawful record retention and provisions intended to survive termination continue to apply.
10. Warranties and disclaimers
To the extent permitted by applicable law, the Service and its reports are supplied “as is” and “as available”. We do not give an additional warranty of accuracy, completeness, fitness for a particular purpose, non-infringement or uninterrupted operation beyond any commitments expressly made at purchase and rights the law makes mandatory.
No result, confidence label, support response, illustration or public example creates a guarantee that an item is authentic or will retain a particular value. Paying for a check purchases the assessment service described in the offer, not a favorable verdict or insurance against loss.
These disclaimers do not exclude any legal obligation to supply a service with reasonable care and skill, as described, or otherwise in conformity with mandatory consumer law.
11. Limits of liability
To the extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential losses, including lost profits, business opportunities, goodwill or data, arising from use of the Service. We do not undertake to reimburse the purchase price, resale loss or alleged value of an item because of an assessment result. Any liability we do have remains subject to the limits and exceptions in this section.
To the extent permitted by applicable law, our total aggregate liability arising from or relating to the Service or these terms is limited to the greater of (a) the amount you paid for Prufo during the 12 months before the event giving rise to the claim and (b) US$100, or its equivalent in your local currency.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, intentional misconduct, gross negligence where it cannot be limited, or any liability or statutory remedy that the law does not allow us to exclude or limit. In particular, these terms do not remove mandatory consumer guarantees, privacy rights or compensation rights. Where a limitation is not permitted, it applies only to the extent lawful.
12. Additional responsibility for business use
If you use the Service in the course of business, to the extent permitted by law you agree to reimburse us for reasonable losses, liabilities and legal costs arising from third-party claims caused by your unlawful submissions, infringement of another person’s rights, fraudulent use of a report or material breach of these terms. This does not cover losses caused by our own breach, negligence or misconduct.
We will give prompt notice of a claim, allow reasonable participation in its defense and seek your consent before a settlement that imposes an admission or non-monetary obligation on you. This section does not apply to you when acting solely as a consumer.
13. Disputes and mandatory consumer rights
If there is a problem, contact support@prufo.app with a description and any relevant report or purchase reference. We will try to resolve it. Contacting us is not a mandatory step before exercising a legal right and does not suspend statutory deadlines.
The law and courts applicable to a dispute are determined by the applicable rules of law. These terms do not choose an exclusive foreign forum, require arbitration or waive any right to bring a claim that cannot lawfully be waived. If you are a consumer, you retain the mandatory protections and access to courts available in your country of habitual residence.
14. Updates and general terms
We may revise these terms to reflect changes in the Service, legal requirements or security needs. We will publish the revised version and its effective date and give appropriate advance notice of material changes, except where an urgent legal or security reason requires otherwise. We will obtain acceptance where required. Changes do not retroactively remove accrued rights or resolve an existing dispute in our favor.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision is not a waiver. We may transfer the Service and this agreement in connection with a genuine business transfer, provided your mandatory rights are preserved and any required notice is given. You may not transfer access rights except as allowed by these terms, Apple’s applicable rules or law.
These terms, applicable offer details and the applicable software license describe the agreement for the Service. They do not override representations or rights that the law requires us to honor. Any translation is provided for accessibility; an English-language interpretation does not override mandatory local-language or consumer protections.
